Amendments to the Aliens Act

On February 24, the Parliament of Montenegro adopted a draft of amendments and supplements to the laws on foreigners.

Amendments to the Aliens Act suggest the exclusion of articles 64 and 66, the use of which, from the perspective of employers, is controversial.

In particular, the rule of Article 64 was that the permit for temporary residence and work of foreigners, as well as the permission for seasonal employment of foreigners, is issued only after obtaining confirmation from the Employment Office of Montenegro (ZZZ) that they have no unemployed, requirements for the workplace, or the unemployed refused this vacancy. Exceptions are: executive directors of foreign companies registered in Montenegro, or executive directors of foreign enterprises that are founders of Montenegrin companies, as well as foreign citizens with higher education in management positions in such companies and private entrepreneurs.

Article 66 put forward the requirement to send a written proposal for a vacancy to the Employment Bureau, and if there is no reason not to satisfy it, the Bureau must issue a confirmation no later than 30 days after the application was submitted by the employer, and the validity of this confirmation is 60 days.

The entry into force of these articles was postponed until November 1, 2015, and now their application was canceled by the approval of annual quotas on January 1, 2016.

Amendments will come into force after they are published in the publication "Sluzbeni list Crne Gore".
